FAQ's

Frequently Asked Questions

Is it worth the trouble suing?
Yes it is worth bringing a compensation claim if the accident that caused your injury was someone else's fault and resulted in significant pain for more than five weeks.

Do you offer a 'no win no fee' service?
Yes. If we believe your claim to be strong we will offer you a 'no win no fee' or 'conditional fee' plaintiff agreement. In the unlikely event that your compensation claim fails, fees for our litigation services, court action costs, expert witness fees and those of the defendant will be covered by insurance.

Won't I have to find the money for an insurance policy?
No. We use leading litigation insurers DAS, who offer extremely good value insurance which does not necessarily involve any up front payment of the premium. This provides protection against your claim failing and covering the defence team's costs of up to £100,000. We can also offer an insurance policy purchased with a loan, which will be repaid by the litigation insurance company should the claim fail.

Who pays the legal costs if I win my compensation claim?
Our fee and your litigation insurance premium will be paid by the defendant's insurance.

Will I have to pay anything?
Only if you fail to cooperate with us in the pursuit of your claim, for example by not attending a medical examination to assess your injury, if you give us dishonest instructions, unreasonably ignore our advice or breach the other commonsense terms of our 'no win no fee' agreement.

I've had an accident at work but my employers have gone bust!
Don't worry. There are emergency compensation arrangements available which will cover your claim and your legal fees if you have a good case.

I've had a road traffic accident in France (or Italy or Germany). Do I have to go to France (or Italy or Germany) to bring my compensation claim or can I do this in the UK?
You can bring your compensation claim here via the UK foreign insurers' agents and Ormerods Solicitors can help you do this.

How much time do I have to make a compensation claim?
You normally have three years to file court proceedings or two years if you have a claim on an aircraft or a ship. If you have had an accident before your 18th birthday, you may have until the age of 21 to file court proceedings. However, it is most unwise to leave it until the last minute to bring a claim.

If I bring a claim will I have to go to court?
There is a chance you will need to go to court, although most claims we handle settle without a court hearing. However, if it is necessary to go to court, we will pursue your claim expertly and vigorously.

What do I do now?
Take advantage of a free initial consultation at our offices or on the telephone, via a UK landline. Please call Margaret Shaw on 020 8686 5000 to arrange this.

We are insurers. Can you help defend claims for us?
Yes. Personal injury partner Simon McIlwaine has been specialising in accident claims for nearly 20 years and has been on the panel of many leading general and motor insurers. Simon also has expertise in the investigation of exaggerated or fraudulent claims. Ormerods Solicitors are delighted to offer special price and service packages tailored to insurer clients. We welcome quality file auditing by insurance or other corporate accident claims clients.

If I win damages, will I lose my entitlement to Housing Benefit or Income Support?
No. If your compensation claim is successful, we can set up a 'Personal Injury Trust', run by two close friends or relatives on your behalf, to open a special bank account to administer the damages entirely for your benefit. Our clients tell us that the savings they make in retaining their welfare benefits greatly outweighs the small fee that we charge for this service. Important note: you must ask for a trust to be set up BEFORE your damages are paid.
